SM announced on 23rd Nov 2010 that TVXQ will return as a duo with Yunho & Changmin, in 2011.
I guess all hell broke loose when fans hear of this news.
I am guessing the biggest uproar came from pro-JaeChunSu-only fans. And of course those who are still supporting all 5 and hoping for a reunion were shaken as well. In fact, even JaeChunSu & HoMin themselves would have felt something.
For Cassies who still supports all 5 and hope they never split for good
It would be hard to accept. I, for one, is still hoping that they will reunite as 5. Yes, I have not given up hope yet. But its not as tough for me. Because I first got into DBSK (5) in Aug/Sep 2011. That is 2 years after the contract controversy started. That is 1.5 years after JaeChunSu debut as JYJ. And lastly, that is 8 months after HoMin came back as TVXQ Act II. By the time I read about DBSK5, JYJ & HoMin, all dust have settled. Cassiopeia have sort of split, fans have chosen sides. Not denying, there are still those who supports all 5. A lot of them in fact. But I am sure, if I was into them, during the period of TVXQ Act II comeback, I would feel shattered. It is like telling me, hey, DBSK is 5 no more. From now on, it is the 2 of us.It is akin to smashing the fan's hope. The last thing that they are holding on to - that the 5 will reunite. What I wrote above is what I think will go through the mind of fans at that time, Jan 2011. Fans who supports all 5 and is looking forward to a reunion. Of course, when given time and with some thinking put into it, emotions will calm and anger (if there is any) will soften.
For Cassies who have already chosen to support JaeChunSu and at the same time makes it a point to bash HoMin
Although they have already chosen to support JaeChunSu (JYJ), by right, they shouldn't be upset about this. Because for them, it should be JYJ only. Whatever happens to DBSK/THSK/TVXQ should not really matter again. At least I think this is how they work. Sorry if I am wrong. However, this group of long live-JYJ, go to hell-HoMin fans would never give up the chance to bash HoMin. Again, I know I sound harsh, but this is the truth. In this ugly controversy, no one is spared from name-calling, from the 5 members, to their parents & families, to SM & SM's staff and to the fans, regardless the fan is pro-JYJ, pro-HoMin or pro-DBSK (5). That is the sad truth. So yes, to these fans, they felt that HoMin have no right to use the name DBSK or TVXQ, because that name belongs to all 5. It cannot belong to 1, 2, 3 or 4 members alone. To come back as TVXQ with only 2 members is as good as saying they want nothing more to do with JaeChunSu.

They basically won't have anything to complain and should in fact be rejoicing. Well, they could also be saying things like, "Yeah, that is how it should be, TVXQ should only be HoMin, forget about the 3 traitors who betrayed you". But of course, once the JYJ-only fans start voicing their disapproval of the TVXQ Act II comeback, these HoMin-only fans will fight back. They will say that HoMin have every right to use the name. Even saying that the name belongs to SM and since HoMin are the ones staying with SM, they get to use the name. Traitors do not get to enjoy the name.
For JaeChunSu
If I am either one of them, I would be heartbroken. Sounds too dramatic. Think about it, how many times have the 5 of them said "Hi, we are Dong Bang Shin Ki". And how many times have each of them introduced themselves as "This is Dong Bang Shin Ki's xxx", where xxx is Uknow Yunho, Youngwoong Jaejoong, Micky Yoochun, Xiah Junsu & Choikang Changmin. They have probably said it so many times that they think Dong Bang Shin Ki is their family name, their last name. The 5 spent 6 years as Dong Bang Shin Ki. Suddenly now, TVXQ is HoMin....only. How would you feel, being JaeChunSu's shoes?
*Arghh, stupid tears falling down again*
Also, from how they have answered in interviews, at least for Jaejoong, they/he still want to reunite with HoMin, still want to be Dong Bang Shin Ki as 5. And then HoMin comes back as Dong Bang Shin Ki, only 2 members. If I am them, it felt almost like Yunho & Changmin telling me and telling the world, from now onwards, you (JaeChunSu) are Dong Bang Shin Ki no more.
For HoMin,
If I am HoMin, I would feel awkward coming back as 2, because in my heart, Dong Bang Shin Ki should always be 5. And I know, I am in no position to deny JaeChunSu as Dong Bang Shin Ki, neither do I want to. Also, imagine the pressure, now 2 have to perform and give the same amount as 5. What about critics? Critics to their voice, their dance, their performance, their choice.
In summary:
1. Besides doing drama and musical, HoMin have lay low for 2010. It is about time they make a come back.
2. JaeChunSu debuted as JYJ in April 2010, looking at it, HoMin took a longer time to come back. They deserve to come back as much as JYJ deserve to debut.
3. You may say "JaeChunSu debut as JYJ, why can't HoMin choose another name". Well, firstly, if they really did choose another name, would it make a difference. The fandom would probably get more chaotic. By choosing another name, letting go of the name Dong Bang Shin Ki, it is as good as announcing that, yes, the members have split, no more Dong Bang Shin Ki. Secondly, like Yunho said, he needed to protect the name DBSK and make sure people don't forget DBSK. To me, that is very true. Thirdly, we all know how much money the name DBSK can bring in. Do you think SM would let the name go easily? Look at how they went to court against Shinhwa for the group's name. And in Shinhwa's case all members left, why do SM even want to keep the name when they don't have even a single member left? So that they can churn out another name and conveniently name it Shinhwa to ride on the fame? Maybe, who knows? So you see, even if HoMin is uneasy about using the DBSK/TVXQ name, or they might have even objected a little, do you think SM would listen? For all we know, SM may have said to them, "Use the name or we will give the name to someone else"
4. Does HoMin have a right to use the name?
I've read that, SM did not manage to get copyright to the traditional writing of Dong Bang Shin Ki (東方神起), but they did manage to get the simplified version (东方神起) and also the international name (TVfXQ or TVXQ) copyrighted. I am not sure about the Korean writing of Dong Bang Shin Ki though.
So, in a way, SM owns part of the name. But of course, the name ultimately belongs to all the 5 boys that is associated with it. So, since HoMin is with SM and SM owns part of the names, then yes, I guess they have a right to use it. SM probably seeked legal advice regarding this too. Or SM could have banked on the love between all 5 boys and knew that JaeChunSu would not do anything against HoMin using the name.
5. But JaeChunSu didn't use the name. And they debut (as JYJ) first. They could have use the DBSK name if they want to.
Well, like I said, SM owns part of the name, depends on how it is written. Sentimental attachment to "DBSK-is-only-DBSK-when-it-is-5" aside, I don't think it would be a smart move for JaeChunSu to use the name. If they did, the first thing SM would do is to sue. And the last thing JaeChunSu need is more lawsuits. Not only is it wasting money and time, lawsuits are also emotionally draining.
My message to JaeChunSu-only & HoMin-only fans:
While you think you know everything, you are actually as ignorant as all of us. Do not be too sure and do not be too quick to judge. Aside from the new JYJ or HoMin fans, the rest were all DBSK(5) fans. How can you change so quickly? Please please please...bring back the hearts that use to love all 5. Even if you can't love the other side, its ok, everyone have their own choice. You may have felt so hurt that you chose to shut your heart out to the other side. All I ask is, just be neutral, be nonchalant, just do not hate.
My message to Jaejoong Yoochun Junsu:
Did you feel disappointed? Did you cry? It is ok, you deserve the right to be upset. You probably were more upset than what you showed to the fans. Yes, you don't have to make it public, but please do not keep it to yourself. Talk to your close friends, your family or talk to each other. And I think you 3 did a good job for not kicking up a fuss and going hysterical over Yunho & Changmin's comeback as TVXQ Act II. I am not sure if all fans saw it. But to me, it tells me you still love Dong Bang Shin Ki a lot, and you definitely still love Yunho & Changmin a lot. Because, if you wanted to kick up a fuss, you could. If you wanted to create some trouble or take the legal route regarding the name, you could. But you didn't, because you care. To me, that is enough.
My message to Yunho & Changmin
Yunho ah, I know it had been tough on you, being the leader, from the time you debut to now. I know you worry about TVXQ being forgotten. I may not speak for all TVXQ fans but I know, anyone who became a TVXQ fan, will always remain as a TVXQ fan. Some may have gotten confused, some may have lost the way. So Yunho, please be healthy and please be strong. Because we need you to reunite all members and we need you to give a reason to the fallen stars (Cassies) to come back where they belong.
Changmin ah, you were the maknae but you were also always the sensible one. Is that because, back at home, you are actually the big brother? Continue being sensible and support your hyungs, but if you ever feel the need to let it all out, I am sure they are always there for you. All of them.
In life, the best decisions are not necessarily the most popular one.
At the times when you think no one cares or no one is making any effort, there are actually a lot of work being done in the background. You just do not know.
There is always a right time and a right place for everything. There may be things (from all sides) which are not made known completely to us, simply because now is not the right time nor right place.
